Terms and Conditions of Services
1. Spinifex Photography refers to the registered business ABN 49074569589. All work performed by Spinifex Photography is bound under these terms and conditions.
2. Photographic Materials: All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of Spinifex Photography.
3. Copyright: All product(s) retain legal copyright of Spinifex Photography at all times, as described under Australian Statutory Law. Any photography supplied to clients, either in a print form, for display on the Internet or for inclusion onto video, cannot be used for any commercial purpose. They are strictly for personal use only. Spinifex Photography reserves the right to use your images for any form of advertising to promote their company, including but not limited to: Web based promotions, brochures, galleries and competitions.
4. Deposits: All professional wedding photographers in Australia require a non-refundable deposit to secure the wedding date. This can be as much as 50% of the wedding photography fee. This fee is to book your date, ensure that nobody else will be booked on that day, and lock in your price. The photographer will not be able to interview anybody or market your wedding date. While this deposit is not paid, Spinifex Photography reserves the right to take alternate bookings, and to increase photography package prices.
5. Exclusive Photographer: For any wedding, Spinifex Photography shall be the exclusive photographer retained by the Purchasing Parties for the purpose of photographing the wedding, and is not liable for photographs spoiled from guest photographers who distract the subjects, or create blasts of flash light, or stand in the shot.
6. Failure to Perform: Spinifex Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that all the photographs have been lost, stolen, damaged or destroyed for reasons within or beyond Spinifex Photography’s abilities, liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the package selected, based on the percentage of originals lost. (All digital negatives are stored in at least two different locations once removed from the camera media.)
7. Photographer: In the unlikely case that your booked photographer cannot shoot your wedding due to illness or some unforeseen circumstance, Spinifex Photography will notify you as soon as they can. Spinifex Photography may substitute another photographer for the purchasing parties wedding day, or if this does not occur, a full refund of any payments, including the deposit, will be made.
8. Indemnification: Clients shall indemnify and hold harmless, Spinifex Photography from any loss, damage or liability resulting from their violation of the terms of the booking or any agreement involving the client and the Photographer. The client shall indemnify Spinifex Photography and hold it harmless from and against any claim by any other person or entity resulting from the performance of services.
